

The goal of Industrial Code Rule 59 is to cut down on injuries and illnesses at work to make New York State workplaces safer and lower the cost of workers' compensation insurance. By law, an ICR 59 consultation must be done by a certified safety consultant for employers with an experience modification of more than 1.20 and a gross payroll of more than $800,000.
When an employer with a workers' compensation premium of at least $5,000 per year and an experience modification of less than 1.30 voluntarily participates in the program established by New York State Department of Labor Industrial Code Rule 60, the employer receives premium credits.
